Welcome to Madhuvan Limited t/a COLOR FUSION. By using our custom printing services, you agree to be bound by the following Terms and Conditions. Please read them carefully. If you do not agree to these terms, you may not access or use our services.
1. Services Provided
1.1 Scope of Services
- We offer custom printing services, including but not limited to printing on apparel, accessories, promotional products, and other specified items.
1.2 Customisation Requirements
- Customers are responsible for providing correct specifications, images, and designs. All images, designs, or text must comply with applicable laws, including copyright and trademark laws.
2. Order Process
2.1 Quotations
- All price quotes are valid for a limited period, as specified, and may be subject to change based on material costs, design complexity, and quantity.
2.2 Order Placement
- Orders are confirmed upon receiving a completed order form and payment as per the terms of the order agreement.
2.3 Design Approval
- A design proof will be provided for approval before production. Production will only commence once you have given written approval. Changes after approval may incur additional charges and delay processing.
3. Pricing and Payment
3.1 Pricing Structure
- We have a fixed pricing of the product with free designing. But if design is more complicated then price may change based on the design.
Additional charges may apply for rush orders and complex customisations.
3.2 Payment Terms
Full payment or a specified deposit must be made before production begins. Payments can be made via Debit Card or Credit Card.
3.3 Refunds and Cancellations
Orders cannot be canceled once production has started. Refunds may be issued at the company’s discretion in cases of production errors or product defects. Please review Section (6) for further details on refunds and cancellations.
4. Intellectual Property
4.1 Ownership of Designs
All original artwork, designs, or content provided by the customer remain the customer’s intellectual property. By submitting content, you grant us the right to use, reproduce, and modify your content solely for fulfilling the order.
4.2 Rights to Promotional Use
We reserve the right to use completed custom products for promotional purposes unless otherwise specified by the customer.
4.3 Prohibited Content
You represent and warrant that all content provided is free of any third-party claims and does not infringe upon any intellectual property rights.
5. Production, Delivery & Pickup
5.1 Production Time
Estimated production time begins once payment and design approval are received. We will make every effort to meet specified delivery dates but are not liable for delays due to unforeseen circumstances.
5.2 Shipping and Delivery
Shipping fees, unless specified, are the responsibility of the customer. We are not responsible for delays caused by the shipping carrier.
5.3 Pickup
Pickup option can be available if address belongs to Auckland. Pickup timing can be discuss with us.
6. Returns, Refunds, and Exchanges
6.1 Defective Products
In case of production errors or defects, notify us within 24 hours of receipt. We will replace or refund defective items at our discretion.
6.2 Non-Returnable Items
Customised items cannot be returned unless defective. Non-customised items may be returned within 7 days of purchase in their original condition.
7. Modification of Terms
COLOR FUSION reserves the right to amend these Terms and Conditions at any time. Any updates will be effective immediately upon posting on our website. Continued use of our services after such updates constitutes acceptance of the new terms.
8. Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from the use of this website or the purchase of products shall be subject to the jurisdiction of the courts of New Zealand.
